Terms of Service

These Terms govern your use of the ADAM website and document-processing service (the "Service"), provided by ADAM AI AG ("ADAM", "we"). By using the Service you agree to these Terms. If your organisation has signed a separate agreement with us, that agreement prevails over these Terms for your paid use.

1. The Service and your account

Subject to these Terms, we grant you access to use the Service for your internal business purposes. You must provide accurate registration details, keep your account credentials secure, and are responsible for all activity under your account. The Service is intended for business users aged 18 or older, and we may update or change its features from time to time.

2. Acceptable use

You agree to use the Service lawfully and not to: upload content you have no right to process; infringe others' rights; attempt to disrupt or gain unauthorised access to the Service; or reverse engineer, resell or copy it except as permitted. We may suspend or terminate access for breach.

3. Your content and responsibilities

You keep all rights in the content you submit, and you grant us the rights needed to process it to provide the Service. You are responsible for ensuring you may lawfully submit it, including any personal data it contains, for which we act as your processor as described in our Privacy Policy.

4. AI output and warranties

The Service uses automated and AI-based processing, which is inherently imperfect and may produce errors. Results are provided "as is", for your review — you are responsible for checking them before relying on them, and they are not professional advice. To the extent permitted by law, the Service is provided without warranties of any kind.

5. Intellectual property and confidentiality

We retain all rights in the Service and its underlying technology and grant you a non-exclusive right to use it during your subscription. Each party will keep the other's non-public information confidential and use it only as needed under these Terms.

6. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost profits or lost data, and our total liability is limited to the fees you paid for the Service. Nothing limits liability that cannot be excluded under Swiss law, such as for intent or gross negligence.

7. Term, changes and termination

These Terms apply while you use the Service. We may update them and will post the new date above; continued use means you accept the changes. On termination we will make your data available for export for a limited period, then delete it as described in our Privacy Policy.

8. Governing law and contact

These Terms are governed by Swiss law, with exclusive jurisdiction in the Commercial Court of the Canton of Zurich (Handelsgericht des Kantons Zürich), so far as permitted by law. If any provision is unenforceable, the rest remains in effect. Contact us at michael@adamai.ch.
